Where can I get updates on the court proceedings? Following the applications made on 22 May 2018, Hyflux has published a notice of the application in the Government e-Gazette on 28 May 2018 and the Straits Times on 25 May 2018. A hardcopy notice of the application will be published in the Government Gazette on 1 June 2018.

Hyflux will also provide updates on the application to all creditors known to the company and that will be involved in the reorganisation.

Who can attend hearings Creditors and other stakeholders can seek the court’s leave to be present at the hearings. Please inform our legal advisors if you would like for them to seek permission for you to attend the hearing. Your attendance is entirely within the court’s discretion. If you have instructed lawyers, they will be able to seek leave and attend hearings on your behalf.

What is a Pre-Trial Conference (“PTC”)? PTCs are meant for case management purposes. They are generally administrative in nature and for the court to give directions on the conduct of the proceedings.

 

If I want to attend a hearing which court do I go to? The court supervised reorganisation proceedings are conducted in the High Court of Singapore, located at 1 Supreme Court Lane, Singapore 178879. The hearing list for ongoing matters which includes the hearing date, time and courtroom number can be accessed via the court website: https://www.supremecourt.gov.sg/

I don’t have a lawyer. Can I still attend Court? Yes with the court’s leave. Please inform our legal advisors in advance if you would like them to request leave for you to attend the hearing.
What should I wear to Court? All attendees should be properly attired when attending court, as visitors in singlets, shorts, slippers or other inappropriate attire may not be permitted to enter the Supreme Court.

1. We refer to the pre-trial conference for HC/OS 731/2018 (the “Application”) on 21 June 2018, and the announcement by Hyflux Ltd on SGXNet on 21 June 2018.

2. Please be informed that the hearing of the Application will be on 6 July 2018 at 2.30pm at Court 4B of the Supreme Court.

3. Registration of interest to attend the court hearing on 6 July 2018 should be made by 2 July 2018 12 noon via email to hyflux.queries@wongpartnership.com with the following information: (a) your name, or the name of your organisation (if applicable), (b) the nature of your interest in the case, and (c) the full names and designation of the persons who wish to attend the hearing on behalf of your organisation. We can then seek leave for your attendance at the hearing.

4. For the avoidance of doubt, PLEASE TAKE NOTICE that both us and our lawyers are not in a position to advise you on your claims, or on your position against Hyflux or any of the applicants in the Applications.

We refer to the six applications filed by Hyflux Ltd. and five of its subsidiaries on 22 May 2018 pursuant to Section 211B of the Companies Act.

Please be informed that a Pre-Trial Conference (the “PTC”) has been fixed before the Learned Assistant Registrar Karen Tan on 28 May 2018 at 10.30am at the Supreme Court of Singapore.

PLEASE TAKE NOTICE that this is not a substantive hearing. The PTC is administrative in nature, to manage the logistics of upcoming hearings. We will keep you updated on the developments even if you do not attend the PTC.

PLEASE TAKE FURTHER NOTICE that there is no need to prepare any court submissions or filings for the PTC. Please do not bring any additional documents relating to any transactions or claims you may have against Hyflux, they would not be admitted at the PTC.
